FREE RIDE CONTEST RULES:

A complete copy of these rules may be obtained at the offices of KQKY/KRNY, 2233 Central Avenue, Kearney, NE 68848, during normal business hours Monday-Friday or by sending a self-addressed stamped envelope to the above address. NRG Media, LLC its subsidiaries and affiliated companies (together, the "Company"), will conduct the Bike Nights at Kearney Powersports Contest (the “Contest”) substantially as described in these rules. Kearney Powersports will award the prize and will offer opportunities to win in other ways than over the radio. By participating, each participant agrees as follows: The Company may conduct the Contest concurrently and simultaneously on several participating stations owned and not owned by the Company, and the Company may add or remove participating stations or change call letters of any participating station at any time during the Contest as announced on the affected station. NRG Media, LLC d/b/a KQKY and KRNY, Kearney, Nebraska are participating stations. Description of Contest/Participation Listeners will qualify during the summer on KQKY and KRNY and at qualifying events conducted by Kearney Powersports for a chance to try to start and win the Grand Prize 2013 Victory Vegas 8 Ball Motorcycle from Kearney Powersports. No purchase necessary. By entering the Bike Nights at Kearney Powersports Contest, you agree to abide by all term and conditions referenced in these Official Rules. Contest begins Thursday, May 2, 2013 and the last day to enter is Thursday, August 1, 2013. The last day to enter and qualify on KQKY and KRNY is July 26, 2013. Qualifiers must be present at Kearney Powersports at 8:30 p.m. Thursday, August 1, 2013, when the Grand Prize Giveaway will occur. HOW TO PLAY AND ENTER ON KQKY AND KRNY EACH STATION WILL SELECT 13 QUALIFIERS (twenty-six (26) total radio qualifiers) WHO WILL HAVE AN OPPORTUNITY TO BE PART OF THE GROUP THAT WINS A CHANCE TO TRY TO START THE MOTORCYCLE. VISIT WWW.KEARNEYPOWERSPORTS.COM TO LEARN ABOUT OTHER WAYS TO QUALIFY! • Each station will give the cue to call three (3) times each weekday between the hours of 6 a.m. to 6 p.m. o Caller ten (10) from each cue to call will be registered for that week’s qualifier drawing on each station.  One (1) weekly qualifier from the fifteen (15) daily qualifiers of that week will be drawn in a random draw on each Free Ride Friday afternoon during the contest (Friday May 10, 17, 24, 31; June 7, 14, 21, 28; July 5, 12, 19, 26) on each station KQKY and KRNY. Each station will draw two (2) weekly qualifiers in one of the contest weeks.  Participants can only qualify to be included in the weekly qualifying drawing once per week. Participants who are successful daily qualifiers but aren’t selected as the weekly qualifier may try to qualify again in subsequent weeks.  Participants who are selected as a weekly qualifier cannot qualify more than one time.  Only one qualifier per household. HOW TO WIN: • On Thursday August 1, 2013 before 8:30 p.m, the twenty-six (26) radio weekly qualifiers need to be at Kearney Powersports, 511 2nd Avenue South, Kearney, NE 68847 • At 8:30 p.m., the twenty-six (26) radio qualifiers will join all the entrants who qualified at events promoted by Kearney Powersports (Bike Nights, Cunningham’s Journal giveaways). The 132 total qualifiers will be randomly divided into four (4) groups (Red, Blue, Green, and Yellow) of thirty-three (33) qualifiers each. • Kearney Powersports will randomly select one (1) of the four (4) groups, and the members of that group will each randomly select one (1) of thirty-three (33) keys. The key-holders will try to start the motorcycle in order of the number of the key they hold. The winner will be the holder of the key that starts the motorcycle first, and the contest will be over at that time. • The winner is the person who holds the key that starts the motorcycle. • Odds of winning depend on number of entries received. Kearney Powersports will select winners at random. All decisions of the NRG and Kearney Powersports are final. Prize(s): The Grand Prize is a 2013 Victory Vegas 8 Ball (approx. value $12,499). The winner must pay tax, title and license fees, and complete required tax forms and prize fulfillment package before the Grand Prize will be released to him/her. The prize fulfillment package must be completed and and postmarked within seven (7) calendar days of receipt or the prize may be forfeited and awarded to another qualifier. Any valuation of the prize(s) stated above is based on available information provided to the Company by Kearney Powersports, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner is solely responsible for reporting and paying any and all applicable federal, state, or local taxes, duties, tariffs, title fees, licensing fees or other fees. The winner must provide Kearney Powersports with valid state identification and a valid taxpayer identification number or social security number on the required IRS forms before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. The Prize may not be sold, traded, or transferred. Failure to collect the Prize constitutes forfeiture of the Prize. If forfeited, the Prize will remain property of the Kearney Powersports and another Winner may not be selected. No alternative Prize compensation will be provided. No cash equivalent for Prize will be awarded. Prizes are not transferable by the Winner to any person. Prizes are not transferable or exchangeable for any other Prize. A list of winners may be obtained by mail after August 1, 2013, upon written request by sending a stamped, self-addressed return envelope to: Bike Night Winner’s List 2223 Central Avenue Kearney, NE 68848 Eligibility and Limitations. Participants, winner(s) and guest(s) must be legal US residents at least 21 years old as determined by the Company. The Grand Prize winner is subject to a verification process to include winner's name, address, home phone number, work/cell phone number, and social security number. If a winner is disqualified, Kearney Powersports reserves the right to determine an alternate winner or not to award that winner's prize, in its sole discretion. Winners are eligible to win only once within 30 days in a contest sponsored by the Company or other entity. Employees, agents, and/or members of the Company, NRG Media, LLC, Kearney Powersports and their subsidiaries, divisions, affiliated companies, promotional agencies, and all promotional partners or sponsors, and all other radio industry employees, and members of the immediate family of any such persons are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Publicity; Use of Personal Information. By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose to third parties personal information obtained from participants in the Contest, including but not limited to name and city of residence, and use such information for marketing and other purposes on a worldwide basis in perpetuity. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the Company to be used, disposed of or destroyed at the discretion of the Company. Such use may include, but is not limited to, enrolling entrant in one or more of the Company’s listener clubs and sending entrant correspondence and solicitations with regard to such clubs. Further NRG Media, LLC is not responsible or lost, mutilated, illegible, misdirected, late, stolen, incorrect or incomplete entries. KQKY/KRNY and NRG Media are not responsible for any deletion, defect, delay in operation or transmission, or communications line failure. Release. By participating in the Contest, each participant and winner, their heirs and assigns indemnifies, holds harmless and waives any and all claims of liability against the Company, NRG Media LLC, Kearney Powersports, parent, related, affiliated and subsidiary companies and their employees, agents, members, affiliates, officers, volunteers or sponsors of each, the Contest's sponsors and their respective employees and agents, for any claim, demand, cause of action, personal injury, death or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited, and anyone behaving in such manner will be disqualified from entering the contest and asked to leave any event associated with the Contest. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules or terminate the contest in its sole discretion at any time. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATE TO THE FULLEST EXTENT PERMITTED BY LAW. 9. Miscellaneous. Each winner must submit proof of eligibility and sign the Company's release form to claim the prize. No purchase necessary to participate or win. Void where prohibited. Odds of winning depend upon the number of participants. The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are available during normal business hours at the business offices of the Station(s) and by mail upon written request with a stamped, self-addressed return envelope. All entries become the property of the Company and will not be returned. To be removed from our direct mail, email or fax lists, visit the main office of the Station during regular business hours, or send a self addressed stamped envelope with contest name to (Company address) 10. Compliance with Law. The conduct of the Contest is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
